Acceptance
By accessing HobbyRank, submitting a listing, or purchasing a placement, you agree to these Terms and the HobbyRank Rules. If you act for a business, you represent that you have authority to bind it.
The service
HobbyRank operates a transparent weekly paid advertising leaderboard for specific sports-card and collectibles promotions. Placement is determined by verified payments for the Eastern Time board active when payment is confirmed. Every live position expires from the public board Monday at 12:00 a.m. Eastern. HobbyRank does not promise any number of impressions, clicks, sales, customers, or any minimum duration at a given position.
Eligibility and listings
You must be at least 18 and legally able to enter a contract. You are responsible for your promotion, destination website, timing, images, availability, prices, claims, products, regulatory compliance, and having all rights and permissions necessary to submit the content. You grant HobbyRank a nonexclusive, worldwide, royalty-free license to display, format, and promote submitted listing content as needed to operate the service.
Payments
Prices are stated in U.S. dollars. Payment processing is provided by a third party. A ranking change occurs only after HobbyRank verifies a completed payment. A payment buys placement only on the board active when it is verified; it does not reserve a future week or survive the Monday reset. Except where required by law, payments are final after placement is provided. A chargeback or reversed payment may result in an immediate rank adjustment or removal.
Enforcement
HobbyRank may reject, edit, suspend, or remove content; block access; or change a rank to address fraud, chargebacks, security threats, legal demands, or violations of these Terms or the Rules. Attempts to manipulate clicks, payments, or another listing are prohibited.
Third-party businesses
HobbyRank does not verify or endorse listed businesses and is not a party to transactions between visitors and listed businesses. Dealings with a listed business are solely between the visitor and that business.
Disclaimer and limitation
The service is provided “as is” and “as available” to the fullest extent permitted by law. HobbyRank disclaims implied warranties and does not guarantee uninterrupted availability or business results. To the fullest extent permitted by law, HobbyRank will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. HobbyRank’s aggregate liability relating to a paid placement will not exceed the amount paid for that placement during the three months before the event giving rise to the claim.
Changes and governing law
HobbyRank may update these Terms prospectively by posting a revised effective date. Massachusetts law governs these Terms, without regard to conflict-of-law principles, and any dispute must be brought in a court of competent jurisdiction located in Massachusetts.
